By the time Lt. William Calley’s court-martial began at Ft. Benning, Ga., his case had already drawn deep divisions in the Army. Officers who felt that his actions at My Lai were justified acts of war were deeply distressed by Army prosecutors, either because they didn’t want the Army’s dark secrets exposed or because they felt it was unfair to single out the young lieutenant.

The Trial

Leading Calley’s defense was former military appeals judge George Latimer, along with a team of civilian and military lawyers. Latimer, 70 at the time and half-deaf, was clearly accomplished but many observers felt he was past his prime and was a dubious choice for an arduous case.

Prosecuting Calley was 28-year-old Capt. Aubrey Daniel. Daniel, drafted into service and serving as a trial counsel at Fort Benning, was seen by some to lack the experience to handle such a significant matter.

In the tiny Georgia tiny courtroom, Calley was charged with violating Article 118 of the Uniform Code of Military Justice — in short, murder of non-combatants. He pled not guilty, and Daniel opened his case.

Daniel told the six-person military jury that it wasn’t enough to focus on Calley, that they needed to understand My Lai and the events that surrounded Calley’s alleged crimes.

“I want to put you there,” Daniel told the jury.

Daniel began his case by calling more than two dozen witnesses to set the scene before he brought in testimony about Calley. Most damning was Pvt. Paul Meadlo, who provided chilling details of the massacre.

At first, Meadlo refused to testify and Daniel was nearing the end of his case. But in a dramatic turnabout, Meadlo agreed to take the stand if given immunity. The private was by Calley’s side at My Lai, and his recollection of the incident — and Calley’s actions — almost three years earlier was devastating.

“He said, ‘How come they’re not dead?’ I said, ‘I didn’t know we were supposed to kill them.’ He said, ‘I want them dead.” He backed off twenty or thirty feet and started shooting into the people,” Meadlo testified.

Almost a month after the trial began, Calley’s lawyers opened their case. But the elderly Latimer was almost incoherent. The defense strategy was muddled at best, stuck between the argument that Calley didn’t commit the murders and the claim that he was just following orders.

Latimer walked Calley through his early years and training, but never quite got to the heart of the defense.

“One of the problems that they had was they didn’t know whether the defense was going to be a flat denial, or whether they were going to say he did it or was ordered to do it,” Judge Reid Kennedy, who presided at the court-martial, told Court TV.

When it was Daniel’s turn for cross-examination, the young prosecutor displayed his talents, exposing the literal-minded Calley’s logical flaws.

“I was ordered to go in there and destroy the enemy,” Calley testified. “That was my job on that day. That was the mission I was given. I did not sit down and think in terms of men, women and children. They were all classified the same, and that was the classification that we dealt with, just as enemy soldiers.”

Calley never quite admitted all of what he was charged with, but was so worn down by the end of Daniel’s questioning that he begged Judge Kennedy for a recess before the military jurors got a turn to question him.

The defense summed up: Calley did little of what he was charged with and was only following superiors’ orders. Then came the prosecution’s turn. Daniel had one more witness: Capt. Ernest Medina, Calley’s commanding officer. Medina, facing his own trial, was called as a witness of the court and flatly denied ever giving those orders to Calley. It was a case of a superior officer’s word against his subordinate’s.

Six days later, after four months of testimony and 104 witnesses, the case went to the jury on March 16, 1971. The jurors deliberated for thirteen days — at the time, the longest deliberation by a court-martial jury.

They found Calley guilty of killing at least 22 people and assaulting at least one. Calley saluted, swiveled precisely and left the courtroom. He was sentenced to spend the rest of his life in prison, at hard labo

How good are the flat fee realtor services?

I have been looking at a lot of flat fee realtor services. Essentially, it is still FSBO, but I pay a flat fee and get MLS listing, signs, flyers, lockbox, paperwork, etc. Would this be a good option?

What can I wear to this funeral? (limited choices)?

My best friend’s stepdad died, and I am currently away at school with only a few options as for what to wear to the service. The options I have:
1. A dark hunter green dress that goes to the knees, short sleeved. (would wear with black leggings)
2. A shorter dress that is black on the top with a black/red rose print on the bottom. (would wear with black leggings)
3. Wide leg black trousers with a black quarter-length sleeve top.

The ONLY shoes I have that would be acceptable for a funeral are dark purple flats…
I never expected I’d have to bring funeral clothes with me to school!

How do I get these two brothers to bond?

My brothers hate each other and it is heartbreaking to watch.

When my mum had my eldest brother, Martin she kept him for ten days and then decided she didn’t want to be a Mum anymore and gave him to my Nan. So my Nan brought Martin up.

Then when Martin was 18 months old my selfish, drug addicted, alcoholic of a mother had another son, Jason. Before she’d even left the hospital with Jason she had decided she didn’t want him and asked her Mum (My Nan) to take custody of Jason.

My Nan said No. She was already looking after 18 month old, Martin. And she said my Mum couldn’t just keep passing everything to her and she had to realise her responsiblities sometime.

So my Mum reluctenly kept Jason. 8 years later she had me (Victoria). My Mum continued to drink and Jason was left to father me. He had to steal food and ask neighbours for milk to try and care for me. He stopped going to school and stayed at home with me. My Mum had a string of unsuccessful relationships and concentrated more on getting her next hit than me or Jason.

To cut a long story short…When I was aged 4 and Jason was 12 social services came round. (I don’t remember this but my Nan filled the gaps.) The social workers found the flat dirty and smelly. There was drug items everywhere and my mum was nowhere to be seen. I was found covered in lice bites with only knickers on and my hair was matted and greasy.

We were immediately took into care. Jason didn’t want to be adopted and I was put up for adoption. My Nan was contacted by social services and she was horrified to hear the condition we were in. My Nan agreed to take me on.

Jason resented his Nan for not taking him in to start with and for making him suffer the awful neglect he did. He resented Martin for having a good childhood and toys and love and affection that he didn’t recieve. He didn’t want to live with his Nan and Martin so was put into foster care.

11 years later. Martin (25) and me (15) were reunited with Jason (23). We’ve all been in touch for 6 years now but Martin and Jason still don’t get on. Its so sad they sit together and speak civily but thwere is no love between them. How can I help them bond together as it’s affecting both of them. What could I do?

10 passengers in a 10 p limo? please help

so origonally i was not going to even get a limo for my wedding. But I found a limo company that said they woulkd do it for $275 flat! Thats an awesome price in the boston area! only problem is that We have ten people in the wedding party and its a 10 passenger limo. Limo driver says its fine (pprob because thats the only size limo and he wants our service) But do you think 5 women and 5 men would fit comfortably in it?? 2 people are on the heavier side and me the bride with my dress.
Do you think I should just get it its a short ride 10 min to the picture area and 20 to the reception. Thanks!!

the mental health services are not helping me, what do i do now?

they’ve failed me ever since my mental health problems came into existence when i was around 15 , – a lot of my mental health problems are a result of life abuses ive suffered , bullying from different people , many people , peers , throughout my life – because i was sensitive and shy and couldn’t ‘ mix ‘ well.

im now 31 , missed out on virtually everything in life , ie, relationships , work, education, qualifications : – ive been in prison for assault because of rage problems 11 years back – been in a mental hospital – because i said things to ” alarm ” psychiatrist to getting me help when i was in prison, because the mental health services were failing me at the time.

im still under the mental health act but in the community.

but the mental health services are still failing me, as in – not giving me the treatment program i feel i need .

i agree with their diagnosis of BPD ( borderline ) , but feel i have co existing anxiety disorders that should be tested and diagnosed..

i cant go out im agoraphobic, have panic attacks if i go out, racing obsessive worries everyday that i repeat , that cripple me from functioning , struggle to hold a train of thought…..mind blanks out, forget things, thoughts race everyday.

they wont give a further test because they thing i have just bpd and antisocial pd.

i struggle with rage , become easily aggressive, struggle to conduct my behaviour in public , cant handle people in general – MADE BIG IMPROVEMENTS WITH MY RAGE FOR YEARS – but still struggle to not become aggressive and threatening.

they wont give me any medication or anti anxiety medication because they said it ‘ masks ‘ the problems i have , has side effects and is addictive….so they wont give me any medication for my extreme anxiety.

they told me theres no psychotherapy available due to lack of resources, and that ‘ im not ready ‘.

all the mental services are offering in a support worker to go out with every 2 weeks , calling it ” graded exposure ” , going out to community centres , drinking tea for 20 mins.

ive withdrawn from this help telling them its not helping or addressing my acute problems of agoraphobia, severe aggression, immense anxiety , racing thoughts, obsessive thoughts , paranoia people are against me ..behavioural problems etc etc.

ive told them i need a proper treatment program of individual psychotherapy regularly , some sort of medication to help me cope for the short term……..and to be further tested to see if i have a coexisting anxiety disorders like : ptsd – ocd or and – GAD.

but they wont give me the treatment im asking for.

so now because im under the mental health act, im threatening to go legal , get the help of a mental health solicitor. to get my rights attended to.

i had a breakdown this morning because my symptoms are all to much and im not getting the help.

so there sending a crisis team to come and
see me , i told them im suicidle ,, im despairing to get the help.

i live in a 1 bedroom flat that ive lived in for 6 years, on disability – trying to keep my head a float with my hard life and all my symptoms.

what do i do next if i feel im not getting the right treatment ?

do i go legal ?

did i do the right thing by ringing the crisis team ?
